Salvadoran man pleads guilty to illegal reentry after prior felony conviction

A Salvadoran national living in Lynn, Massachusetts, pleaded guilty on September 26, 2025, in federal court to illegally reentering the United States after being deported. Emelio Neftaly Pineda, age 46, admitted to one count of unlawful reentry of a deported alien before U.S. Senior District Court Judge Patti B. Saris. Sentencing is scheduled for October 30, 2025.

Pineda was indicted by a federal grand jury in July 2025. According to court documents, he had previously been deported around July 20, 2016, following a felony conviction.

The charge carries a maximum penalty of up to ten years in prison, three years of supervised release, and a fine that could reach $250,000. After serving any imposed sentence, Pineda will be subject to deportation again. Sentences are determined by federal judges according to the U.S. Sentencing Guidelines and relevant statutes.

United States Attorney Leah B. Foley and Patricia H. Hyde, Acting Field Office Director for U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston announced the plea agreement. The case is being prosecuted by Assistant U.S. Attorney Elizabeth Riley from the Criminal Division.
