A Dominican national residing unlawfully in Chelsea has been indicted for illegal reentry into the United States following deportation. Dawin Hereaux-Pena, 30, faces one count of unlawful reentry of a deported alien.

According to charging documents, Hereaux-Pena was deported from the United States to the Dominican Republic on or about February 5, 2019. Allegedly, he unlawfully returned to the U.S. and was arrested in Chelsea on May 29, 2025.

The charge carries a potential sentence of up to two years in prison, one year of supervised release, and a fine up to $250,000. Following any sentence imposed, the defendant is subject to deportation. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and statutes.

United States Attorney Leah B. Foley and Patricia H. Hyde from U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations announced the indictment. Assistant U.S. Attorney Fred M. Wyshak is prosecuting the case.

The allegations outlined in the charging documents remain unproven until established beyond reasonable doubt in court.
