A Brazilian national residing in Weymouth has been indicted for illegally reentering the United States after being deported. Josimar Fernandes-Pessoa, 38, faces one count of unlawful reentry of a deported alien.

The indictment states that Fernandes-Pessoa was removed from the U.S. in 2019 after being apprehended near the U.S.-Mexico border in Texas. Before his removal, he pleaded guilty to improper entry by an alien in the Western District of Texas. It is alleged that after his 2019 removal, he unlawfully reentered the country.

The charge carries a potential sentence of up to two years in prison, one year of supervised release, and a fine of up to $250,000. The defendant is subject to deportation following any sentence imposed. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and statutes.

United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston announced the indictment. Assistant U.S. Attorney David Cutshall is prosecuting the case.

It is important to note that the details contained in the charging documents are allegations, and the defendant is presumed innocent until proven guilty beyond a reasonable doubt in court.
