A Brazilian national residing unlawfully in Framingham has been indicted for illegally reentering the United States after deportation. Joelson Gomes Fonseca, aged 39, faces a charge of unlawful reentry of a deported alien.
According to court documents, Fonseca was deported in March 2008 following a conviction for an aggravated felony. The charge he faces carries a potential sentence of up to 20 years in prison, three years of supervised release, and a fine of up to $250,000. After serving any imposed sentence, Fonseca is subject to deportation once more. Sentencing decisions are made by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.
The announcement was made by United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston. First Assistant U.S. Attorney Katherine Ferguson is prosecuting the case.
It is important to note that the details within the charging documents are allegations at this stage. Fonseca remains presumed innocent unless proven guilty beyond a reasonable doubt in court.
